(Research notes): John Malone (possible older brother of Robert) and Robert Malone, as well as Graves Eaves, lived in the Cathey Creek area of Rutherford County North Carolina from the late 1770's..

My John Malone may be the son of Robert Malone, born about 1750 in Virginia. Robert Malone appeared in Rutherford County, NC as early as 1779, when he was granted 100 acres on Ball's Branch of Cathey's Creek, adjacent to William Gilbert. Rutherford County Deed Book A-D, p. 204, August 13, 1779.

Robert Malone was living in Cathey Creek area in 1790 census, with a son under age 16, who would have fit the 12 year old age of John Malone, Lavinia's father. To date, no other information has been discovered about either John Malone or Robert Malone or their wives.

Lavinia, Spencer, Robert Lewis and Ledford Bayles are known to be children of John and Gracie by family sources. Jones lived adjacent to John in both Jasper and Meriwether Counties, witnessed deeds, etc., and is thought to be John's son. John, Jr. is believed to be a son since John, Sr. administered his estate in Butts County, and his death is noted in the Ledford B. Malone family Bible. Burwell Malone is believed to be a son since he lived near John Malone in Jasper County and was living near Jones Malone in Pike County in 1830. Additionally Gracie's father was believed to be Burwell Eaves. Burwell's death is also noted in the Ledford B. Malone family Bible. William B. Malone's death is also mentioned in the family Bible. One other son is indicated by the census as having been born 1815-1820, but remains unidentified.

(Research Notes):From Ancestry:

According to his great granddaughter, Mrs. Ira Quinton Adams (nee Eula Lee Jackson) in a letter from Glenn, GA, dated May 7, 1934, "He was born in 1800, and his father came to Walton Co. GA in 1802 with a group of colonists. They were of Scots-Irish descent. His mother was German."

This is not entirely accurate, however, as Walton Co. was not formed until 1818, partly from Jackson Co., which had been created in 1796. And census records give Samuel's birth as around 1796, rather than 1800. He appears on the 1820 census of Jasper Co. GA living next to his father-in-law, John Malone. He had married John's eldest daughter, Lavinia, about 1817, but no record of the marriage has been found. Also nearby in 1820 Jasper Co. was Mary Jackson, aged 45, and Charity Jackson, a young woman, both apparently widows with children. Charity was probably the widow of Coleby Jackson, who died in 1818 and whose land was adjacent to John Malone's. She was co-executor of Coleby's estate with Benjamin Cook.

Samuel was a fortunate drawer in the 1820 Land Lottery. As a resident of Eastes District in Jasper Co., he won Lot 64 in the 3rd District of Walton Co., and apparently took up residence there for a couple of years.

No connection has been found between Samuel W. and other Jacksons in Walton Co., particularly with William or Samuel Jackson here, who were of Clarke Co. GA origins.

In Dec 1822, Samuel W. sold 149 acres on the west side of his lot in Walton Co. to David Johnson for $950 (Walton DB CD-265). At the same time he bought a half-acre lot from Johnson (lot 170) in the town of Monroe for $175 (Walton DB CD-266). A month later, in Jan 1823, he sold an acre of Lot 64 to Andrew Baker for $100, "where old man Baker settled" (Walton DB CD-248). Witnesses were Wiley Cook and Herndon L. Henderson. That same year Samuel moved to Pike Co. GA, and in September bought lot 134 in the 2nd District of Pike Co (Pike Co. DB A-260). In July 1824 he sold his half-acre lot in the town of Monroe to Herndon L. Henderson for only $5 (Walton DB F-155). That same month he bought Lot 221 in the 8th District of Pike Co. for $500, from Francis Garner of Walton (Pike DB A-368). Witnesses included Wiley Cook. In Jan 1825 Samuel sold his remaining 100 acres of Lot 64 in Walton Co. to Harley Baker for $400, the land being "where Baker now lives" Walton DB F-127). In March 1825 Samuel sold his lot in the 2nd District of Pike Co. (Lot 134) to Wiley Cook (Pike DB A-388). Samuel had paid $400 for the lot and sold it for $500. (By 1830 Cook was in Harris Co. GA. He was in Troup Co. GA in 1840 and in Chambers Co. AL in 1850.) And in March 1827 Samuel W. sold his other lot in Pike Co. (Lot 221 in the 8th District) to James R. Gray, make a $100 profit on this lot as well (Pike DB B-236). Samuel W. may have moved to Meriwether Co. in 1826, before he sold this last lot in Pike Co., even though Meriwether was not officially open for settlement at that time. According to his daughter-in-law, Mrs. Brooks R. Jackson, in a 1964 letter, Samuel's son Lee Roy was said to have been born in a log house in Meriwether Co. in Oct 1826. In any case, Samuel W. was in Meriwether for the 1830 census. But there is no evidence that he bought land there before January 1832, when he bought Lot 9 in the 8th District for $125 (DB B-168). In Oct 1833 he sold the west half of this lot to his father-in-law, John Malone of Butts Co. GA (DB C-286). Witnesses were Jones Malone, thought to be John's son, and Littleton Grimsley. Grimsley had married Malinda Jackson in 1827 in Pike Co. GA. She is said to be the daughter of Coleby R. Jackson (Grimsley Workbook by Robert E. Parkin, St. Louis MO). Coleby R. Jackson was aged 60-70 on the 1830 census of Meriwether Co. and lived near Samuel W. Jackson. A Coleby or Colley Jackson married Malinda Henley in 1829 in Meriwether with Littleton Grimsley as ...

From Ancestry re Colbey Jackson, possible father of Samuel W. Jackson:
He was listed as a resident in the census report in Meriwether Co., GA, 1830. Coleby R. Jackson was born in the 1760's according to the 1830 census, and probably in NC. He first appears in the 1793 Tax Digest of Greene Co. GA, along with Randolph, Peter, and Reuben Jackson. In 1796, the four were in Kimbrough's District in Greene Co., and a second Peter appears on the list as well. In 1797, the same five men were listed in Tigner's District. A second Coleby appears on the list, thought to be the one who moved to Jasper Co. GA. At least one Coleby was still in Greene Co. in 1803, to register for the 1805 Land Lottery. His two draws were both "blank." Neither Coleby is listed in Greene Co. deed records as either a buyer or a seller. The whereabouts of Coleby R. between 1805 and 1830 is a mystery. He may have been the Coleby who witnessed a deed in Morgan Co. GA in 1814, of Rolin Jackson to Azariah Bailey (Morgan DB E-230). In 1827 a Malinda Jackson married Littleton Grimsley in Pike Co. GA. She is said to have been the daughter of Coleby R. Jackson (Grimsley Workbook, by Robert E. Parkin of St. Louis). The couple soon moved to Meriwether Co. GA. In 1829 Woody Jackson married Eliza Jackson in Pike Co., and in 1830 he was living near Coleby R. Jackson in Meriwether Co. A Woody Jackson was in Greene Co. GA in 1827, winning Lot 231 in the 9th District of Meriwether Co. in the Land Lottery. He sold the lot in 1831 (Meriwether DB B-235). No record of Coleby R. Jackson has been found in Pike Co. But in 1830 he was on the Meriwether Co. census, aged 60-70, with wife aged 50-60. Also in the home was another male 20-30 and a female 15-20. These last two may have been Colley or Coleby Jackson and wife Malinda Henley, who had married in Meriwether Co. in 1829. There is no evidence that either of these Colebys owned land in Meriwether Co. But in 1832 Coleby R. won Lot 122 in the 24th District of Gilmer Co. GA in the 1832 Land Lottery. There is no record of Coleby R. Jackson after January 1835, when he and Samuel W. Jackson witnessed a deed between James Hately and John Malone (Meriwether DB D-76). . Coleby's ancestry is currently (August 2000) unknown, but this writer speculates that he may have been the son of Peter Jackson and Susannah Randle.

The Heard County History Book indicates that Samuel's father was named William, but there is no research that I can find to support this theory. All of this research needs to be verified.

(Research):

Confederate Memorial Park was the site of Alabama's only Confederate Veterans home. The facility was in operation from 1902 to 1939 for the care of elderly veterans and their wives and widows. Of the many hundreds who resided at the facility, 313 were buried in one of the two cemeteries located at this site. I believe that Henry's wife was named M.J. Weathersby - she lived in Clarke County MS and she filed a claim for a Confederate pension in 1911 based on his service. According to this application, they were married in 1859, and H.F. enlisted in the army in 1861 in Clarke County MS.

Although I am treating this H.F. Weathersby as "mine", there is no direct evidence that he is. However, there is no evidence to the contrary. He did die in the military hospital that his brother, Stephen C. Weathersbee, died in.

His enlistment papers indicate that he was born in Alabama, and this would not agree with information for my Harry Weathersbee; his enlistment papers place his birthdate in 1831 or so.

A lives-lease agreement, dated 12 September 1765, with George William Fairfax of Loudoun County, Virginia, is the earliest confirmed recordof HENRY ADDINGTON. The lease for 150 acres near the Potomac River names his wife, SARAH and their youngest son WILLIAM. HENRY built a log house with seven rooms, a root cellar, and four fireplaces on this property in 1767, in accordance with the lease agreement. The house is listed on the Historical Register. It has been restored, modernized,and is being lived in today. On 17 June 1768, he transferred the lease to Charles Snyder for 80 pounds current money.

Geo. Wm. Fairfax of the county of Fairfax and Colony of Virginia, Eng. Henry Adington of the county of Loudoun and Colony of Virginia, Eng.

Geo. W. Fairfax for and in consideration of the rents and covenants hereafter mentioned on the part of Henry Adington hath Demised Granted and to farm let unto Henry Adington a certain parcel of land situated in the County of Loudoun bounded by a survey made by John Hughes.

Beginning at a small white oak on a hill side the South side of a Branch being the N W corner of Thomas Land lot extending thence West 38 poles to a small black oak corner to John Gores lot then with his line N 130 poles to a W by a Branch Gores corner still N 20 poles further to two small hiccories in poison Field the East 200 Poles to W in a line of Earl Tankerviller land on the side of Suckey hill then with same line S 21 W 60 poles then with another of his lines S 13 W 140 poles to a Double black oak S E corner of said Lambs lot then with his line West 120 poles to the beginning. Containing 150 acres.

During the natural lives of Henry Adington, Sarah his wife and William his son and the longest liver of them yielding and paying unto Geo. W. Fairfax , yearly and every year during the continuance of this Demise on or before the first of May the rent or sum of three pounds to be discharged in cash or tobacco at 10f sterling PC or wheat a 2/6 SP bushel that is good and merchantable to be delivered at some public landing on the navigable part of potowmanch river paying also the Quit Rents and upon the Death of any two of the persons above mentioned Henry Adington, his heirs, shall have liberty to nominate two other persons paying thirty Shillings Sterling for renewing each persons life provided he or they plant at least one hundred good Apple trees thirty feet distant from each other and keep them well pruned and also cause to be built a Dwelling House at least sixteen feet wide. The said Apple trees and house to be planted and built within two years from the date hereof and other such houses as his way of Husbandry may require and keep Houses and orchards in good repair provided also that no subtenant shall be admitted by Henry Adington, his heirs, on the tenement, nor shall be suffered to dwell on any part thereof at the experation or sooner determinate of this Demise. Henry Adington, his heirs, shall deliver the said Houses, Orchards and fences on the said land n good tenantable.

Suffer to be made any waste or spoil on the woods under woods or tree or timber to the said tenement.

If the said Henry Adington, his heirs, shall neglect or fail in the performance of any of the stipulated covenants previson and agreements and so continue for the space of one whole year he or they so neglecting or failing shall forfeit and pay unto G.W. Fairfax the sum of five pounds current money...if it shall so happen that all or any part of the rents or Quit rents herein reserved shall be unpaid by the space of Ninety Days after becomes due in any year...the same be not demanded and no sufficient disturbs can be found on the premises...Geo. W. Fairfax to renter and to have again.....
