    • T.J. Keller was appointed as the administrator of Samuel's Estate on October 7, 1844.
      On January 4, 1848, a Final Settlement was filed in the Estate of Samuel Swinney. The settlement, on page 219, provided that Thomas J. Keller, the Administrator, was to pay over 458.83, share and share alike, to the heirs as follows:
      to Jeremiah V. Swaney one Eighth part of said Sum which is fifty Seven dollars and thirty five cents
      To Turner Swaney the like sum of fifty Seven dollars and thirty five cents
      To John Scott the like sum of fifty Seven dollars and thirty five cents
      To John Brown the like sum of fifty Seven dollars and thirty five cents

      The administrator of Nancy Swinney's Estate was also mentioned in this settlement.

    • This land was located in the West Half of the Northeast Quarter of Section 12, Township 53 North, 35 West of the 5th Meridian in Platte County, Missouri. A book called the Official Copy of the Land Record, Platte County, Missouri contains a land map containing this parcel which indicates that Samuel Swinney was living on this land as early as June 15, 1843.
      Probate records indicate that Samuel was dead by October 7, 1844. Was this just a case of the government's paperwork being really slow to be completed?

    • I have not been able to find a marriage for Samuel Swinney, and there is no evidence that Nancy was the mother of Mary, Jeremiah or Cornelius. In a consent given for Nancy Swiney to marriage, Nancy Swiney refers to the younger Nancy as "her daughter".

      I found the following on the Clark County KY GenWeb site[http://www.rootsweb.com/~kyclark3/clark/will1.htm]:

      My wife, Sarah. My sons, William, John, Samuel, Robert, and James. My daughters, Elisabeth Green, Sarah Turner, Mary, and Cathen. My wife and son, James, Exe. Written: 24 May, 1799. Witnesses: David Scott, James McLoland, Paul Hoff, Richard Wharton, George Sharp, Thomas H. Moreland, and Richard Whatton. Probated: November, 1799

      What makes this especially interesting is that Sarah Swinney Turner was married to a man named Cornelius Turner - and my Samuel is said to have a son named Cornelius Turner Swinney.

      In my notes is the following will abstract for Daniel Swinney, which is the basis for identifying his children, including Samuel and Sarah:

      My wife, Sarah My sons, William, John, Samuel, Robert, and James. My daughters, Elisabeth Green, Sarah Turner, Mary, and Cathen. My wife and son, James, Exe. Written: 24 May 1799 Witnesses: David Scott, James McLeland, Paul Haff, Richard Wharton, George Sharp, Thomas H. Moreland, and Richard Wharton Probated: November, 1799.

      The other thing that ties Samuel and Sarah Swinney together is the fact that Samuel named a son Cornelius Turner Swinney, that being the name of Sarah's husband.

      Cornelius and Sarah (Swinney) Turner married in 1794 in Madison Co. KY, which is adjacent to Clark Co. where Daniel Swinney died. Cornelius was on a Madison Co. tax list in 1800 and then appears in Warren Co. in 1810. Barren Co. is immediately east of Warren Co. Perhaps Samuel Swinney and Cornelius Turner headed out from central Kentucky around the same time, thus establishing to bond that led to Samuel naming his son after Cornelius.

      Several of Cornelius Turner's brothers and several of Cornelius and Sarah's children moved to Missouri, including Montgomery, Randolph, Howard and later Cedar counties, although those aren't particularly close to Platte and Clinton counties. I think Kentuckians looking to get away at that time (whether from the law or otherwise) headed to Missouri.

      No question, Southern families in this era are maddeningly difficult to trace. You've done well with the court, land and probate records. Someday I will have to dig into those, too.
