    • From the Court of Ordinary Minutes, 1852-1858, November Term, 1852, page 49:

Martin Pollock haveing applied to this court for temporary letters of administration on the Estate of Stephen Weathersby late of said county deceased & given Bond _____ and it appearing also that the personal Estate is likely to decrease in value if not sold before the granting of letters of administration can be had, it is upon motion therefore ordered that said Temporary Administrator have, and authority is hereby given to him to sell the personal estate of said deceased upon his giveing ten days notice thereof and it is further ordered that B. R. Fuller, R. Davis, Saml Day, Milton M. Moore & John Pollock be appointed appraisers of said Estate. Signed A. P. Beale

[Note - Burley R. Fuller owned 40 acres in the same lot (218) as Stephen; in the 1840 census, he was shown living next to William Weathersby. Martin Pollock owned Lot 219, just north of Stephen's lot, and I believe him to have married a daughter of Stephen.]

From page 62: Martin Pollock was appointed administrator of Stephen Weathersby, dec'd on February 7, 1853. Notice of citation was published in the Weekly Times & Sentinel. A one thousand dollar bond was posted by Martin Pollock. Martin stated that he believed that Stephen Weathersby did without leaving a will.

From page 79, May, 1853: Martin Pollock applied for an order allowing him to sell land belonging to the dec'd, Stephen Weathersby. He stated it was necessary to sell the land for the proper distribution of the Estate among those entitled thereto. It was stated that the required notice had been published for 2 months.

[I have not been able to find any sale of this land in the Randolph County deed records, either under the Weathersby name or the Pollock name.]

From page 101, October 1853 Term: A petition was filed by John Johnson & "other legal heirs" of Stephen Weathersby late of said county deceased. In this petition it was alleged that Martin Pollock had moved out of the county, was notoriously insolvent and likely to make ways with the effects of the Estate; mismanagement and neglect were also alleged. The Court ordered that the petition be served on Martin Pollock.

I have not been able to find out any more about the disposition of Stephen's estate. I read through page 200 and found no more mentions of Stephen Weathersby or Martin Pollock. In the Court of the Ordinary Minute Book for 1858-1871 there is no "Weathersby" in the index.

Marriage Record - John Johnson & Ally Weathersbee

  • Notes
    • John and Alley were living next to Ben Johnson, age 64, born in North Carolina, and his wife, Elizabeth, age 63, born in North Carolina , in the 1850 census. According to Vance Pollock, Martin Pollock's sister, Elizabeth, married a Benjamin Johnson and lived in south Georgia. Is this the same Elizabeth Johnson?
