    • James died on or after November 18, 1804 and before January 1, 1805. December 22, 1804 is often given as the date of his death, and this happens to be the date that his father John committed James' nuncupative will to writing.

    • James Collier's will was a nuncupative will - an oral will, traditionally considered a "death bed" will. John Collier, Senior, and John Collier, Junior, were witnesses to James' declaration, first on November 16, 1804, and then again on November 18, 1804. This oral declaration was committed to writing on December 22, 1804, and proved in court in Madison County, Kentucky on January 7, 1805.

      The will mentions James' "children", "his wife", and "his three sons", but does not specifically give their names. This will was recorded in Vol A, at pages 299-300 of Madison County, Kentucky Wills: Probate Records: Vol. A-A1: 1787-1813: Kentucky State Archives: roll#7012790.

      Further probate proceedings were recorded in Volumes B & C of Madison County, Kentucky probate records. The inventory of James' property was filed on July 3, 1815 (yes, 1815, not 1805) and is recorded on pages 176-178 of Volume B: 1814-1819 of Madison County, Kentucky: Wills: Probate Records, Kentucky State Archives, Roll #7012790. James' property consisted of cows, sheep & hogs, along with various farming implements and household items. The inventory was apparently compiled as of August 30, 1805 by Joseph Elison, Stephen ham and John Moberley, but not filed until 1815.

      The most helpful of all of the probate papers was an accounting filed on July 15, 1815. One of the items listed in the accounting was as follows:

      "The allowance to the widow for raising Schooling &c of Six Children, to wit, William, who was 12 years old, Rebecca who was 10 years old, Stephen who was 6 years old, Nelly who was 4, Lewis who was 2 years old and Milley who was born 3 months after her fathers Death which was in 1804..."

      This accounting also revealed that John Colier was acting as Administrator for James' estate. The accounting was approved by the court on October 2, 1815.

      This information was contained on pages 190-192 of Volume B, 1814-1819, Madison County, Kentucky: Wills: Probate Records, Kentucky State Archives: roll# 7012790.

      A second accounting was filed on January 5, 1817; this accounting mentioned James' widow, Sally Collier by name and was recorded on pages 350-351 of Volume B, Madison County, Kentucky: Wills: Probate Records, Kentucky State Archives, roll #7012790.

      A third accounting filed on November 2, 1819 revealed that Nicholas Hocker had been appointed as the Guardian for Nelly Collier, Lewis Collier & Milly Collier. John Mills (the second husband of Sarah Easton Collier) was mentioned as renting land in 1815-1816 belonging to the heirs. By this time, Nelly Collier, who was 4 years old when her father died, had married a man with the last name of Armstrong.

      This accounting was recorded on pages 41-42, Volume C of the Madison County, Kentucky: Wills: Probate Records, Kentucky State Archives, Roll# 7012790.

      A supplemental inventory was filed and approved for James' Estate on August 6, 1821; this document was recorded on pages 172-173, Volume C of the Madison County, Kentucky: Wills: Probate Records, Kentucky State Archives, Roll# 7012790.
